Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of QRLinkManager, a service developed and operated by EMLA Consulting SRL (“we”, “our”, “us”). By creating an account or using the platform, you agree to these Terms. Please read them carefully.

QRLinkManager is a Software-as-a-Service (SaaS) platform enabling businesses to create and manage link pages, QR-based interactions, review flows, and related analytics.

2. Eligibility

To use QRLinkManager, you must:

be at least 18 years old
have the legal authority to represent a business or entity (if applicable)
accept these Terms in full

3. Your Account

You are responsible for:

providing accurate information
maintaining the confidentiality of your login credentials
all activity that occurs under your account

If you suspect unauthorized access, notify us immediately.

We reserve the right to suspend or terminate accounts that violate these Terms or pose security risks.

4. Services Provided

QRLinkManager offers features including:

customizable link pages
review guard flow (feedback collection)
analytics (page views, link clicks)
branding customization
integrations with third-party services (Google, Facebook, Instagram, WhatsApp, Revolut)
subscription management
admin tools for multi-business oversight

Features may be modified, updated, or removed as the platform evolves.

5. Subscription Plans and Billing

QRLinkManager operates on a subscription model via Stripe.

5.1 Plans

Each plan includes specific limits (e.g., number of links, available link types, review guard availability). Plan details, pricing, and limits are shown within the platform.

5.2 Billing Cycle

Billing date is the 10th of each month.
New subscriptions may include a trial period depending on the selected plan.
The first invoice may be prorated.

5.3 Payment Processing

All payments are handled by Stripe. We do not store any payment card information.

5.4 Failed Payments

we retry after 3 hours, then every 24 hours
you enter a 5-day grace period
if payment still fails → account is suspended

5.5 Cancellation

You may cancel anytime. Your subscription remains active until the end of the billing cycle already paid.

5.6 Refunds

We do not issue refunds for partial periods, unused services, or incorrect configurations.

6. Acceptable Use Policy

Users must not:

use the service for unlawful, harmful, misleading, defamatory, or fraudulent activities
attempt to hack, reverse-engineer, or disrupt the platform
misuse QRLinkManager to deceive end-users
send spam or collect data without consent

We may suspend or terminate accounts violating this policy.

7. Customer Feedback (Review Guard)

If you use the Review Guard feature:

You must ensure your customers understand that their feedback is collected privately.
You must not misuse, publish, or manipulate their submitted content.
You are responsible for complying with applicable privacy laws for feedback you receive.

We store feedback on your behalf and make it available only to you and authorized administrators.

8. Third-Party Services

QRLinkManager integrates with third-party platforms such as:

Google Maps / Google Places
Facebook
Instagram
WhatsApp
Revolut
Stripe (billing)

You agree to follow the terms of those services when using related features. We are not responsible for outages or issues originating from third-party integrations.

9. Data Protection and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

As the data controller, we comply with GDPR and ensure secure processing of personal data.

10. Intellectual Property

All content on the platform, including:

software
design elements
branding
user interface
internal tools
generated QR pages

is the property of or licensed to EMLA Consulting SRL.

Users retain ownership of:

their business name
uploaded logos
link content
feedback collected through review guard

You grant us a non-exclusive license to use this content solely to provide the service.

11. Service Availability

We strive to provide uninterrupted service but cannot guarantee:

100% uptime
instantaneous bug fixes
uninterrupted integrations with external services

We may perform maintenance, updates, or improvements that temporarily affect availability.

12. Liability

To the maximum extent allowed by law:

We are not liable for any indirect or consequential damages.
We are not responsible for revenue loss, reputation damage, or missed opportunities arising from service downtime or misuse.
Our liability is limited to the amount you paid for the service in the previous 12 months.

Nothing in this section limits liability where prohibited by law.

13. Termination

We may suspend or terminate your account if:

payments fail after the grace period
you violate these Terms
you misuse the service or infringe on rights of others
we are required to do so by law

You may terminate at any time through your dashboard.

Upon termination:

your public page becomes inaccessible
your data may be retained temporarily (see Privacy Policy)
we may permanently delete your data upon request

14. Changes to These Terms

We may update these Terms occasionally. When we do, we will:

update the “Last updated” date
notify users of significant changes

Continued use of the service implies acceptance of the updated Terms.
